Terms of Service

1.Services

Tydal Designs provides website design, website maintenance, search engine optimization (SEO), and related digital services to local businesses. Specific services, deliverables, and pricing are detailed in the Client Contract signed at engagement.

2.Payment

• All prices are in USD.
• Website builds require full payment upfront before work begins. Work does not commence until payment is received and confirmed.
• Monthly services are billed automatically via Stripe on a recurring basis.
• Payments are non-refundable once work has commenced, except as outlined in the cancellation policy.
• Overdue invoices (14+ days) may result in service suspension.

3.Cancellation Policy

• Monthly services may be cancelled with 30 days written notice to zach@tydaldesigns.com.
• No cancellation fees for monthly services.
• Website build payments are non-refundable once design work has begun. If Service Provider has not yet commenced work, a full refund will be issued within five (5) business days.
• Tydal Designs reserves the right to cancel services with 30 days notice and a full refund of any prepaid fees.

4.Client Content & Accuracy

You are responsible for the accuracy of all content, information, and materials you provide. Tydal Designs is not liable for errors resulting from inaccurate information provided by the Client.

5.Intellectual Property

• Upon full payment, Client owns the website content and custom design created for them.
• Tydal Designs retains the right to use completed work in portfolio and marketing materials.
• Third-party assets (stock photos, fonts, plugins) remain subject to their original licenses.
• Tydal Designs retains ownership of any proprietary tools, processes, or frameworks used in delivery.

6.Domain & Hosting

• Domains registered on behalf of clients remain the property of the client.
• Hosting arrangements are managed by Tydal Designs and included in the monthly maintenance fee.
• Upon cancellation, clients may request full transfer of domain and hosting access within 30 days.

7.SEO & Results Disclaimer

Search engine optimization involves factors outside Tydal Designs' control including Google algorithm changes, competitor activity, and domain age. We do not guarantee specific rankings, traffic numbers, or revenue results. We guarantee consistent, professional execution of best-practice SEO strategies.

8.Limitation of Liability

To the fullest extent permitted by law, Tydal Designs shall not be liable for indirect, incidental, or consequential damages including lost revenue, lost data, or business interruption. Our total liability shall not exceed the fees paid in the 30 days prior to the claim.

9.Uptime & Downtime

While we strive for maximum uptime, we are not liable for downtime caused by third-party hosting providers, domain registrars, or internet infrastructure beyond our control. We will respond to reported outages within 24 hours on business days.

10.Privacy

We collect business contact information solely to provide our services. We do not sell client data to third parties. Payment information is processed securely by Stripe and never stored by Tydal Designs.

11.Modifications

Tydal Designs reserves the right to update these Terms at any time. Clients will be notified by email at least 14 days before material changes take effect. Continued use of services after that date constitutes acceptance of the updated Terms.

12.Governing Law

These Terms are governed by the laws of the State of Maryland, USA. Disputes will be resolved by good faith negotiation, followed by binding arbitration in Maryland if necessary.
